Terms and Conditions

These Terms and Conditions (“Terms”) govern Engineering Education Australia Pty Ltd (“EEA”) and each delegate ("You" and where the context requires "Your") that has registered to attend a course (“Course”) or registered for any online material hosted by EEA.

Please read the Terms carefully as they contain important information and You will deemed to have read and agreed to be bound by these Terms upon submitting Your registration to EEA.

These Terms and Conditions (“Terms”) govern Engineering Education Australia Pty Ltd (“EEA”) and each delegate ("You" and where the context requires "Your") that has registered to attend a course (“Course”) or registered for any online material hosted by EEA.

Please read the Terms carefully as they contain important information and You will deemed to have read and agreed to be bound by these Terms upon submitting Your registration to EEA.

1. Registrations

1.1 Your registration is subject to acceptance by EEA which will be acknowledged in writing after EEA has received Your fully completed registration, the fee related to Your registration ("Fee") and any required supporting documents. EEA may in its absolute discretion refuse to accept Your registration.

1.2 The Fee for the Course is correct at the time of publication. EEA reserves the right to change the Fee at any time but these changes will not affect registrations that have already been confirmed in writing by EEA.

2. Terms of Payment

2.1 Website registrations can only be paid using an authorised credit card (merchant fee/ surcharges apply) at the time of the transaction on the EEA website. 

2.2 Should You be paying by invoice option, payment can be made by EFT, BPay, credit card (merchant/fees may apply) or cheque. Receipts can be provided on request.

2.3 EEA takes reasonable measures to ensure that the EEA website is secure and to ensure that any information provided by You for the purposes of payment is kept secure.

2.4 You agree to make full payment for the Courses prior to commencement of a Course unless prior arrangements in writing have been made.

3. Cancellations - Delegates

3.1 Notification of cancellation of Your registration for a Course must be made in writing and sent by You to EEA by email. The notification must include all relevant information. Cancellations made by phone will not be accepted.

3.2  Should You withdraw from a Course by notifying EEA in writing, an administrative fee will be incurred as per below:​

24 Hours from Course commencement date

100% total course fee

2-5 Business Days (inclusive) from Course commencement date

50% total course fee

6-10 Business Days (inclusive) from Course commencement date

25% total course Fee

>11 Business Days (inclusive) from the Course commencement date

no administration fee incurred

3.3 If You fail to attend the scheduled Course, this will not be accepted as a cancellation and You will forfeit all Fees for that Course.

3.4 Should You register for a blended learning and/or e-Learning Course, You will not be entitled to a credit note upon purchasing of these products. Please note: a blended learning Course has both online and face-to-face components.

4. Transfers and Substitutes - Delegates

4.1 Should You transfer to another Course by notifying EEA in writing, an administrative fee of 5% of the total Course Fee will be incurred.

4.2 Should the Course to which You wish to transfer to, be of higher value than the original Course, EEA will issue a credit note for the original Course, less the 5% administration fee and a new invoice for the new Course You will be required to pay the difference.

4.3 Should the Course of which you wish to transfer to be of lower value than the original Course, EEA will issue a credit note for the original Course, less the 5% administration fee and a refund of the balance owing. 

4.4 Only one (1 ) transfer per delegate per Course is permitted unless You can provide evidence in writing of extenuating circumstances. A 5% administration fee may apply for multiple transfers at EEA’s absolute discretion.

4.5 If You wish to send a substitute attendee to the Course in Your place, You must advise EEA in writing.  A $50 Administration Fee will be incurred.  If the notification is received less than 24 hours, any dietary requirements for the substitute attendee may not be possible to be catered for.​

5. Modification / Postponement / Cancellation of the Course

5.1 EEA reserves the right at any time to:

a) change the format, participants, content, location and timing or any other aspect of a Course;

b) postpone a Course; or

c) cancel a Course or any part of a Course.

5.2 EEA will not be liable to You for any damages, costs, losses or expenses of any kind incurred or suffered by You as a result or in relation to EEA modifying, postponing or cancelling a Course.

5.3  EEA reserve the right to cancel or postpone a Course at any time without incurring any additional liability to You. EEA will offer alternative Course dates or a refund of the Fees.

5.4 Force Majeure - EEA shall not be liable for any failure of, or delay in, the holding of a Course for the period that such failure or delay is due to causes beyond its reasonable control, including but not limited to acts of God, war, strikes or labor disputes, embargoes, government orders, pandemics, or any other force majeure events.

6. Delegate’s rights and obligations at the Course

6.1 EEA reserves the right, in its aboslute discretion and without any liability to You, to refuse You admission to, or to eject You from a Course, including (without limitation), for failure to comply with these Terms, or if in the reasonable opinion of EEA, You represent a security risk, nuisance or annoyance to the running of a Course.

6.2 You agree to comply with all reasonable instructions issued by EEA or the facilitator of a Course.

6.3 All unauthorised photography and the recording or transmitting of audio or visual material, data or information is expressly prohibited at a Course and/or in or at the venue.

6.4 You acknowledge that You may be filmed, sound recorded and/or photographed by EEA at a Course.  In this circumstance, You may be asked to sign a waiver.

6.5 You agree as a participant of an EEA Course to:

  1. not copy, rent, lease, sub-license, loan, translate, merge, adapt, vary or modify the training materials or documentation except where copying is necessary for the purposes of completing the relevant Course;
  2. not alter or modify, the whole or any part of the training materials or documentation, nor permit the training materials or any part of them to be combined with, or be incorporated to, any other materials;
  3. include the copyright notice of EEA on all entire and partial copies you may take of the training materials or documents on any medium; or
  4. provide or otherwise make available the training material or documents in whole or in part, in any form to any person without the prior written consent from EEA  and ensure that the use of the materials is in accordance with these Terms.
7. Intellectual Property Rights

7.1 You acknowledge that all intellectual property rights in all materials related to or created for a Course belong to EEA.

7.2 You agree that You have no rights in the materials other than the right to use the materials for the purposes of Your participation in a Course.

7.3 You agree to indemnify EEA against any loss, damage or expense which EEA  incurs as a result of Your improper use of Course materials.

8. Entire Agreement

8.1 These Terms and any document/s expressly referred to in them, represent the entire agreement between You and EEA in relation to the purchase of any Course, program, training material and documentation and supersedes any prior agreement, understanding or arrangement between You and EEA whether written or oral.

8.2 EEA and You acknowledge that in entering this agreement, neither has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between EEA and You prior to entering this agreement, except as expressly stated in these Terms.

8.3 Neither EEA or You shall have any claim in respect of any untrue statement made by the other, whether in writing or orally, prior to the date of entering this agreement (unless such untrue statement was made fraudulently) and the other party’s only remedy shall be for breach of contract as provided in these Terms.

8.4 EEA reserves the right to amend, change and/or update these Terms at any time without prior consent or notice. 

9. Privacy

9.1 EEA is committed to protecting Your privacy and the confidentiality and the security of the personal information provided by You. The personal information You provide is necessary to process Your registration form which may include updating Your record and profile information.

9.2 We may use Your personal information to contact You about professional development and associated events, the latest news in an EEA update, to conduct analysis or market research, to identify the ongoing needs of registrants and to generally provide You with information on services and benefits.
